New P& Z

New P&Z (Property & Zoning) committee members were duly appointed and voted in at the Feb 5 City Council meeting. They are Omega Hawkins, Bob Woodward and Wallace Boyd. Returning P&Z members are Michelle Henry and Dale (or Dell...sorry but don't know the last name...) and Fred Nowitzi is an Alternate.
(NOTE: Carlton Stanton had previously added his name to a list of those interested in serving on the P & Z, along with other residents of the area. Mr. Stanton grew quite upset during the Council meeting when Mayor Taylor explained an existing City ordinance mandates P&Z committee members must actually live in the city for a period of at least 6 months. Mr. Stanton does not live in the City which everyone knows because he will repeatedly and proudly tell you he does NOT live in the City.)

In other action, the Council set the date of the City election for Saturday, May 12. Assuming the City follows the uniform election dates set by the Texas Secretary of State, election dates will be:
**First Day to file for Place on Ballot February 10, 2007
**Last Day to file for place on Ballot March 12, 2007
Last Day to Order General Election March 12, 2007
First Day to Apply for Ballot by Mail March 13, 2007
Last Day to Register to Vote April 12, 2007
First Day of Early Voting April 30, 2007
Last Day to Apply for Ballot by Mail (received not Postmarked) May 4, 2007
Last Day of Early Voting May 8, 2007

You can receive the proper forms to file for a place on the ballot at City Hall.

A Policies and Procedures agenda item as tabled. Then the Council adjourned for yet another Executive Session regarding the police department.

WHY DOES A P&Z VOLUNTEER HAVE TO LIVE IN THE CITY LIMITS AND A CITY COUNCIL MEMBER(BETSY) NOT HAVE TO ???? IF THE CITY IS GOING TO GO BY THE RULES SHOULDN'T THE ABIDE BY "ALL" THE RULES ????

The law and the 'rules' DO require that Councilperson Dennie live within Combine city limits, but she does not. She is fully aware of this law, and she was asked to remove herself but she refused to do that. Frequent written and verbal requests were made to your Mayor and sitting Council to remove her, but they were not willing to do that nor were they even willing to ask her to step down.
So, she has unlawfully remained on the Council.

Well who and where do we go to report this offense, if the council refuses to take action ? Is there nothing that can be done.

You can try questioning the Mayor and Council about the situation during the Citizen Comment section of the next Council meeting. The meeting is probably Monday March 5. (Sign in to speak at the door.)
This could also be reported to the Kaufman County District Attorney's office and to the Texas Secretary of State's office.

sounds to me like those attempts previously fell on "deaf ears"....i guess nobody even cares so why should the council or mayor do anything if the citizens don't have the heart to push it ?!?!?!?!

You would probably want to consult the Secretary of States office and or the State Attorney Generals's Office and cite Texas Local Government Code, Section 23.024 (a). The OAG has ruled on this article in the past and upheld the Code. If you want to read it just Google Texas Local Code Section 230024 (a) and you can get to the OAG's ruling

ha isnt it a little embarrassing that we are atalking about contacting the state agancies to try and get our mayor and council to do their jobs and remove a person who is breaking the law from the council ?!?!?!?!?!?!

Please allow me to pass along som info that you dont seem to have.
The old council tried for at least a year to get Betsy off the council. They spent an untold amount of money with the city atty. looking for a legal way to do it. The city attorney, Mr. Sheppard, finally sent an E-mail to Bruce Coats, who was Mayor Pro-tem, at the time, in which he told them that not only was there no way to do this, but also that if they did'nt stop that both they and the City could be sued by her for harrasment.
Let me admit that I rarely agreed with Mr. Sheppard, but this time he must have been right.
if he had'nt been, they would have still been at it when they were voted out.
Betsy has worked harder than any councilperson, past or present,
to get our roads fixed. I only wish she could run again.

All she has to do is bring her property into the city limits and pay the property taxes she owes. Then she can run as many times as she wants.

SO THEN MR NORMAN YOU ARE SAYING THAT IF THE COUNCIL ENFORCES THE LAW THEN THEY AND THE CITY COULD BE SUED B/C THE WERE ATTEMPTING TO UPHOLD THE LAW THAT WAS WILFULLY & KNOWINGLY BROKEN BY MS. DENNIE ???....THAT IS VERY INTERESTING....NEXT TIME I GET A TICKET FROM COMBINES FINEST I WILL GET A LAWYER AND SUE THE CITY, OFFICER, MRS. MCBURNEY AND THE COUNCIL B/C I WAS BEING "HARRASSED"......SOUNDS LIKE THE TAIL IS WAGGING THE DOG @ THE CITY OFFICES.
